Terms of Sale.
Short, in plain language. Nothing hidden in the small print.
1 · Acceptance
By purchasing, downloading, or using Elba, you agree to these Terms of Sale. If you do not agree, do not buy or use the software.
2 · Who you're buying from
Elba is sold by Meanwhile, a partnership under Dutch law, based in
The Netherlands ("we", "us"). Payments are processed by Paddle.com Market Ltd., which acts as the merchant of record and reseller of the software. Your receipt and invoice will show Paddle alongside our name.
3 · What you're buying
A one-time perpetual license to use Elba — a single HTML file that runs locally in your browser. There is no server component, no subscription, no account. See the License for the full terms of use.
4 · IP ownership
Meanwhile VOF retains all intellectual property rights in Elba, its source code, documentation, branding, and trade marks. Your purchase gives you a license to use the software as set out in these terms and the License; it does not transfer ownership of any part of the software to you.
5 · Price and payment
The price shown at checkout is the price you pay. Local taxes (VAT, GST, sales tax) are calculated and displayed by Paddle at checkout based on your billing address. All prices are in Euros unless otherwise stated.
6 · Delivery
Delivery is digital and immediate. After payment, you receive an email with a download link for the Elba package (a single .zip containing Elba.html and its launchers). If you do not receive the email within one hour, check your spam folder, then write to us — see Contact.
7 · Refunds
See the Refund Policy. In short: 14 days, no questions.
8 · Misuse and prohibited use
You may not use Elba for any unlawful purpose, to infringe anyone else's rights, or to distribute malware. Elba's source is published alongside the binary — you are welcome to read it, audit it, and learn from it. You may not, however, remove or circumvent the license notices, or resell or redistribute the binary beyond the single gift copy included in your package. You may not abuse our site or services or interfere with their operation.
9 · Suspension and termination
We may suspend or terminate your access to updates, support, or download links if you materially breach these terms, commit fraud, or create a security or legal risk. Termination does not affect your right to keep and use the copy of Elba you already have under the License.
10 · What Elba does and does not do
Elba encrypts a folder on your own computer using AES-256-GCM with a key derived from your passphrase. It does not send your files anywhere. It cannot recover your passphrase if you lose it — no one can. That is the point. See the Manual for the full picture of where the fence ends.
11 · Warranty
Elba is provided as-is, without warranty of any kind, to the fullest extent permitted by law. It has been built with care and released as source alongside the binary so you can verify it. It is not a substitute for backups, and we make no claim it will protect you from every threat — read the Manual for the honest boundary.
12 · Liability
To the fullest extent permitted by law, our total liability arising from your purchase is limited to the amount you paid for the license. Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited by law.
13 · Governing law
These terms are governed by the laws of the Netherlands. Nothing here removes any statutory rights you have as a consumer in your country of residence.
14 · Changes
We may update these terms. The version in force at the time of your purchase is the version that governs your purchase.
